What are your options when a contract is breached?
I have an agreement with an Amish Cabinetmaker that I would show his kitchen cabinets on my showroom floor. The cabinets were secured and glued to the wall, Our agreement was that I would waive a monthly fee for the showrrom space the display would stay on my floor and I would receive a 10% brokerage fee on any kitchen sold by being seen at my business. Now 4 years into our agreement he wants to pull the kitchen out. I expressed my concern over the damage to the walls and the fact he is breaching our agreement. I explained to him that if the display was not to be permanent I would have charged him a monthly fee for displaying the kitchen. He wants $2500.00 if he leaves the kitchen on display 1/2 of the retail cost. If I would have been collecting lease payments for the space it would have been $3600.00 a year. I need 6-8 weeks to get more merchandise in ti fill the empty space that would be left. Any suggestions on this matter?
